AN ACT relating to real property; adopting the Uniform Real Property Electronic Recording Act; validating electronic documents for recording; authorizing electronic recordings by county clerks; imposing duties on the department of enterprise technology services; providing for rulemaking; providing definitions; and providing for effective dates.
- Currently, Wyoming law provides that only originally signed real property documents or properly certified or authenticated copies thereof may be recorded by the county clerk of a county.
- This act adopts the Uniform Real Property Electronic Recording Act (Act), validates electronic real property documents for recording and authorizes the recording of these documents by county clerks.
- This act requires the Department of Enterprise Technology Services (ETS) to promulgate rules to implement the Act. The act further directs ETS to consider specified standards, practices, technology, views and needs when adopting rules.
- This act requires county clerks who accept electronic recordings of real property documents to establish procedures governing the electronic recordings consistent with the rules promulgated by ETS.
