In every state in the U.S., the law says that when a person dies intestate, their property passes to the next of kin. However, each state interprets “next of kin” differently. These laws are important to attorneys, landmen and mineral owners because it provides a sanctioned method of determining ownership in real property in the event of the death of a mineral owner. For landmen, this is important because you may discover a stranger to title in your record search and there is no valid will to state who the heirs are.
